Have you noticed that more and more frequently there are bright yellow directional signs in Algiers Point with only one word or even just initials on them?  Welcome to Hollywood South, what the locals are affectionately calling the metro New Orleans area with all of the star sightings and movie pre-production work happening in our city.

Today, I was popping in to fill the flyer box on a fantastic home for sale at 269 Elmira Avenue in Algiers Point, when I realized that there is yet another movie currently being filmed in the neighborhood.  Trucks, crew members, trailer sized generators... all for the work being done on "Patriots, " a film about Marrero basketball coach All Collins (starring Forrest Whitaker) that is currently filming in what seems like every nook and cranny of the Point around the River Road.

Check out all of the action that was happening outside of the Old Point Bar and across the street at Warren's Corner.  There was a prop sign on the outside of the building at Warren's, but the police were moving everyone along and I couldn't get a picture of it.  

My friend (and client!) that lives in the area was lamenting the fact that the crew had covered up the green street and the painted shamrocks that were left from Algiers Friendship Day last month at the corner of Olivier and Patterson (River Road).  But, good news, they have agreed to repaint the entire street when filming is complete...right down to the fire hydrant!  The corner just wouldn't be the same without it.

While the city as a whole still has a way to go in the recovery process, how great is it to live on the West Bank and get to witness the local economy being boosted by Hollywood?  All I can say is...lights, camera, action!

Barkley Estates: April 2008 Neighborhood Real Estate Market Report

Watching the recent activity on my previous posts, it seems that lots of folks are interested in the Barkley Estates sales information, so I thought it would be a good time to do a neighborhood update.

First, some current statistics in Barkley Estates as of 4/28/2008:

  • Active listings = 14
  • Under contract listings = 2
  • High list price = $589,900
  • Low list price = $305,900
  • Average list price = $434,507

All information is from the Gulf South Real Estate Information Network and is deemed reliable but not guaranteed.

And a look at the recent homes sales in Barkley Estates:

Not only has the number of homes sold increased since the 4th quarter of 2007, but check out that average sold price!  Good news for home sellers in Barkley Estates, who are getting about 9% more for their homes in 2008 than they were at the end of 2007.  Note the average days on market, though, which indicates that sellers are waiting a little longer to get these prices.  I'll be able to update the sales information after my clients close on their new Barkley home soon - get ready to meet your new neighbors!

Absorption Rate:  An estimate of the rate at which home sales can be expected to occur, based on historic sales information.

One of the keys to properly pricing your New Orleans West Bank home to sell is to review the absorption rate for your community.  Absorption reports tell you how many homes are for sale in various price ranges, how quickly homes in those ranges are selling and estimates your statistical odds of a sale in the next 90 days.

West Bank Weekend Events - April 25-27, 2008

It's hard to compete with the Jazz Fest, but there are some great weekend events happening on the West Bank of New Orleans....

 VOL Cajun Festival

Visitation of Our Lady Cajun Festival

Amanda Shaw kicks off the festival Friday evening at 5:30, followed by Jr. and the Swamp Pop Players at 8:30 pm.  Saturday's music includes Abdul and the Tentmakers, the Topcats and Five Finger Discount.  The fun continues on Sunday with Redfish, Bucktown All Stars (one of my favorite local bands) and Molly Ringwalds close out the festival starting at 6:30 pm.  Food, fun and games all weekend at the corner of Barataria and Ames in Marrero, LA.

Saturday, from 8:30 am to 12:30 pm, rain or shine.  Under the Gretna Market on Huey P. Long Avenue, between 3rd and 4th Streets in Gretna, LA.  Locally grown produce along with music, crafts and more.

The Tri Beta chapter of Our Lady of Holy Cross College will be holding a plant sale, raffle and BBQ on Saturday from 9 am - 3 pm.  Taking place out under the gorgeous oak trees that dot the campus on Woodland Highway in Algiers, it's a great way to start your Saturday on the West Bank.

The Barataria Preserve of Jean Lafitte National Historical Park and Preserve in Marrero is the site of many special programs designed to help children learn more about national parks.  On Saturday from 10 am til 2 pm, kids can take a wetlands walk, participate in a science lab and create their own craft project to take home.

Recycling Day in Westwego

Saturday from 9 am - noon at the Alario Center in Westwego.  Plastics, paper, cardboard, paperboard, metal/aluminum cans and lids will be accepted.  NO glass containers or hazardous materials will be accepted.  The ARC of Greater New Orleans will be accepting beads for recycling at the same event.

The Bellemeade Swim Club will be holding an open house on Sunday from noon to 6 pm with food, drinks and fun for the entire family.  (You do not have to be a resident of Bellemeade to join the Swim Club)  If you are looking for a family friendly place to cool off this summer in Gretna, check out the swim club and all of their activities at 501 Brookmeade Drive.

New Orleans Jazz and Heritage Festival

One of the premier festivals, not just of Louisiana, but in the entire country, the Jazz Fest kicks off on Friday and continues on Saturday and Sunday and next weekend as well.   With a stellar line up of music and some of the best food you will ever eat in your life, Jazz Fest is a local tradition.  Don't be surprised if lots of folks in your office call in sick on Friday to head out for the opening acts!

The end is in sight!  Here we are at the final section of the Louisiana Property Disclosure form that all sellers are required to provide.

A quick recap about disclosures:

 

Home sellers in Louisiana (including for sale by owners) are required to provide a property disclosure prior to a potential buyer making an offer to purchase.  This mandate applies not only to sales, but also to exchanges, bond for deeds and lease purchase options.

If the property disclosure is supplied to the purchaser after an offer is received, the purchaser can terminate the purchase agreement without penalty up to 72 hours after receipt.  This means that no matter what terms are written in the sales contract, the purchaser can demand the return of their deposit and cancellation of the purchase agreement if the disclosures are not signed at the time an offer is submitted


Our final section of disclosures is a catch all of questions about your home - the Miscellaneous section.  The fact that they are in the miscellaneous section does not mean that these questions are not just as important as all of the others on the disclosures!

 

Louisiana Property Disclosures 

 

 Has there ever been property damage to the land or improvements?  This is a very broad question that needs to be specifically answered.  Any prior damages to the property need to be disclosed.  For example, in my own home, I had a plumbing backup that caused water damage to the flooring in 2 rooms.  After the plumbing repairs were done, the flooring was replaced.  If I ever sell my home, I will need to disclose this, even though it happened over 5 years ago.  Any problems that led to an insurance claim should absolutely be disclosed - insurance companies have a database of claims relating to a property!

If yes, were all damages repaired?  In the comments section, explain how the damages were repaired.  In my example it would be damaged flooring removed, slab cleaned and disinfected and new flooring installed.

 

What is the zoning of the property?  This is particularly important when selling vacant land, since zoning restrictions may prevent a buyer from using the property in a manner they plan to.

Has it ever been zoned for commercial/industrial use or is it located in a historical district?  It is important to note if a home is located in a historical district, since there are strict regulations regarding exterior changes to those properties.  Again, a purchaser needs to be aware of any limitations on their use of or ability to alter the property.

 

Does the property and its present usage conflict with zoning, building or safety restrictions?  If you own a property that has been granted a special zoning status, this needs to be disclosed, since that status may not be transferable to a new owner.

 

Are there any current or pending assessments, dues, liens, taxes owing on the property?  If so, you should know that the title company will require these to be paid prior to or at the act of sale in order to provide a clear title to the new owner.

Is membership in an HOA, COA or POA required as a result of owning this property?  If yes, copies of the appropriate association documents should also be included with the disclosure.  Potential purchasers need to review these documents to fully understand any restrictions that exist when owning the property.

Are any HOA, COA or POA dues required?  Some associations have voluntary but not mandatory dues.  If dues are mandatory, this must also be disclosed.

If yes, what is the amount?  The current amount of annual or monthly dues.

Are there any pending special assessments?  If you know of any pending special assessments, this must also be disclosed.  For example, a HOA may have approved a special assessment to be charged to home owners for upgrades to community amenities that has not been assessed yet.  Buyers need to know if there will be any additional costs involved with owning the property.

If yes, what is the amount?  The exact amount of the pending assessment must be disclosed.

Were any additions or alterations made to the property?  Any changes made to the original structure should be disclosed.  For example, a sun room that was enclosed to make a den or an attached garage that was converted to additional living area are alterations that need to be disclosed.

If yes, were the necessary permits and inspections obtained?  Often in the New Orleans area, sellers do not know if the permits and inspections were obtained by previous owners for alterations or additions to the property since this is not information that is tracked by the assessors office.  Buyers should not be alarmed by an answer of NK to this question, but sellers should be aware that if they have made changes without permits and inspections, this needs to be disclosed to avoid future problems.

 

Is there a homestead exemption in effect?  This question is especially important in Orleans Parish, where property taxes are paid in advance.  At the act of sale, property taxes are pro-rated between the buyer and the seller - if there is no homestead exemption in effect, this will mean a higher rate of taxes will be paid by the purchaser at closing. 

Note to buyers:  Be sure to file your homestead exemption as soon as possible after your sale is recorded!  This exemption saves you approximately $900 per year in property taxes, but can only be used for your primary residence.

 

Is there high speed internet access available to the property?  If there is cable TV service available to the area, then there is high speed internet access as well, even if you don't currently have this service.

 

 Is there any pending litigation regarding the property?  Any pending lawsuits must be disclosed, including if the home is currently in the process of foreclosure, even if it has not been foreclosed on yet.

 

Does the property or any of its structures contain any of the following?  Here is your laundry list of potential hazards that must be disclosed to a buyer.  If any of them exist, they must be fully outlined in the explanations section.

A quick recap about disclosures:

Home sellers in Louisiana (including for sale by owners) are required to provide a property disclosure prior to a potential buyer making an offer to purchase.  This mandate applies not only to sales, but also to exchanges, bond for deeds and lease purchase options.

If the property disclosure is supplied to the purchaser after an offer is received, the purchaser can terminate the purchase agreement without penalty up to 72 hours after receipt.  This means that no matter what terms are written in the sales contract, the purchaser can demand the return of their deposit and cancellation of the purchase agreement if the disclosures are not signed at the time an offer is submitted


The next section of the Louisiana property disclosure form deals with the condition of the electrical system in your home, along with the heating and cooling systems and all appliances:

Are there any defects with the electrical system?  As always, if you know of an existing issue, it outlet must be disclosed to any potential purchaser.  Additionally, most insurance companies are asking about upgrades to electrical systems before issuing policies.  If you have updated any of the electrical components in your home (for example, changing the fuse panel to a breaker box) it's a good idea to put this in the explanation section.

Are there any defects with the heating or cooling systems?  I hope that you have been having your air conditioner and heater checked and serviced annually by a licensed A/C and heat contractor.  If not, I advise having the system cleaned and serviced and checked for any leaks prior to putting your home on the market.

What type of cooling system is installed?  Choose the type of system in your home.  If there are multiple systems, use the explanation section to outline them in detail.

What type of heating system is installed?  Choose the type of system in your home.  Again, if there are different types of heating installed in different areas of the home, use the explanation section to outline them.

If a fireplace exists, is it working?  This is an important question in the New Orleans area, since many of our historic homes have the original mantles and fireplace openings, but the fireplaces are purely decorative and not functional.

Are there any defects in any permanently installed or built-in appliances?  If you know that the self cleaning function on your oven doesn't work, this is the time to disclose it to any potential buyers.  Again, this form is to protect your interests, as well as inform the buyer about the condition of the home.

Louisiana Property Disclosures Part 3 - Structure

In parts 1 and 2 of this series, we covered the Louisiana property disclosures involving Land and the disclosures involving Termites and Wood Destroying Insects.


A quick recap about disclosures:

Home sellers in Louisiana (including for sale by owners) are required to provide a property disclosure prior to a potential buyer making an offer to purchase.  This mandate applies not only to sales, but also to exchanges, bond for deeds and lease purchase options.

If the property disclosure is supplied to the purchaser after an offer is received, the purchaser can terminate the purchase agreement without penalty up to 72 hours after receipt.  This means that no matter what terms are written in the sales contract, the purchaser can demand the return of their deposit and cancellation of the purchase agreement if the disclosures are not signed at the time an offer is submitted.


Our third section of Louisiana property disclosures involve the details about the structures located on the property and the condition of those structures.The first section of structure involves defects in the major components as follow:

LA Property disclosures 

A known defect is defined as:  A condition found within the property that was actually known by the seller and that results in one or all of the following:

  • It has a substantial adverse effect on the value of the property
  • It significantly impairs the health or safety of future occupants of the premises
  • If not repaired, removed or replaced, significantly shortens the expected normal life of the premises

The next part of the structure section addresses specific concerns about the property and its condition:

LA Property Disclosures 

Has any structure ever taken on water by flooding (rising water or otherwise)?  Once again, I will remind you that it is imperative to be honest in answering these questions.  Any flooding, even if was way back in 1965 for Hurricane Betsy, needs to be disclosed and fully explained to potential purchasers.  Additional explanations can include drainage improvements made by the city or parish since that time.

What is the approximate age of all structures?    Oftentimes, a garage or shed has been added since the original construction of the home, so there may be a difference in ages between structures on the premises.

What is the approximate age of the roof of each structure?  Again, there may be an age difference between the roof of a home and the roof of a garage, guest house or shed.

Does the property contain EIFS or other synthetic stucco?  Given the troubled history of EIFS in Louisiana with our almost constant humid and moist climate, purchasers may want to have a stucco inspection performed on properties containing this product.  It is imperative to disclose the existence of any form of synthetic stucco on a property.

What is the approximate square footage of the living area of each structure?  What is the source of this information?  If you have builder's plans or an appraisal, the square footage can be taken from these sources.  If you do not have this information, your agent can measure the property for you and be cited as the source. 

 

NOTE TO BUYERS:  Many square footage measurements in Louisiana are provided by the listing agents and should be considered an estimate, not a guarantee, of the living area of a home.  Your appraiser will provide you with a more precise square footage measurement.
